The Constitutions of 1840 and 1852 Remain Intact and In Effect; the Remaining Constitutions Had Issues

Kamehameha III - Kauikeaouli's Constitutions of 1840 and 1850 remain intact to this day.
The reason being that the 1852 Constitution was never abrogated by Kamehameha IV - Alexander Liholiho; Kamehameha V - Lot; and King William Charles Lunalilo.

1840 - October 8. The Constitution of 1840 was the foundation, the basis of the Hawaiian Government, etc.
1852 - The Constitution of 1852 was signed and approved by Kamehameha III - Kauikeaouli.

1887 - The 1887 Constitution was not ratified/approved and was signed under duress, stress, coercion, and usurpation by King Kalakaua who signed with a gun to his head. His sister later known as Queen Liliuokalani did name the incident "The Bayonet Constitution".

1893 - The Constitution signed by Queen Liliuokalani in 1893 was destroyed soon after she signed it, and a"purported" Constitution was recorded by treasonous persons and validated by the U.S. Congress thereafter(It was Congress and the U.S. President who authorized the military to take over Pearl Harbor 8 days before the dethronement of Queen Liliuokalani. See the article Pearl Harbor Coaling Station article which was posted above.
Summary
Kamehameha III - Kauikeaouli's Consitutions were made in 1839, 1840, and 1852. Although Kamehameha V- Lot Kamehameha's Constitution was signed in 1863, the 1852 Constitution remained in effect because it was not abrogated.
Although the Constitution of 1863 was signed by Kamehameha V - Lot Kamehameha, it was a "rewrite" of the Constitution of 1852.
The 1887 Constitution called the "Bayonnet Constitution", and the 1893 Constitution of Queen Liliuokalani were made under duress, stress, usurpation, coercion, intimidation, etc. and null and void.
The 1852 Constitution continues on legally, lawfully. :
'The Constitution of 1852 served as the Constitution from 1852 through 1864.' The Constitution of 1852 continued on and remains the legal, lawful Constitution of the Hawaiian Kingdom/ Kingdom of Hawaii, aka's till today.
"It was passed during the reign of King Kamehameha III. It heavily liberalized the structure of the Hawaiian government compared to the previous 1840 constitution, introducing new elements of democracy into the government and reducing the influence of the monarch in kingdom affairs.
The 1852 Constitution of the Kingdom of Hawaiʻi was divided into seven parts.
The seven parts were:
1. Declaration of Rights
2. Form of Government
3. Of the Executive Power
- a. Section I: The King, His Prerogatives
- b. Section II: Of the Kuhina Nui
- c. Section III: Of the Privy Council
- d. Section IV: Of the King's Ministers
- e. Section V: Of the Governors
4. Of the Legislative Power
- a. Of the House of Nobles
- b. Of the House of Representatives
5. Of the Judiciary
6. General Provisions
7. More Amending of the Constitution
The Declaration of Rights stated that the Hawaiians were a free people.
The Form of Government stated that Hawaiʻi was a Constitutional Monarchy.
The section "Of the Executive Power" declared the powers of the executive power.
The section "Of the Legislative Power" declared the powers of the legislative power.
The section "Of the Judiciary" declared the powers of the judiciary.
The General Provisions stated anything unmentioned earlier besides the amending power.
The final section allowed for amending of the constitution."
One of the most valuable parts of the 1852 Constitution pertains to slavery:
"12. Art. 12. Slavery shall, under no circumstances whatever, be tolerated in the Hawaiian Islands: whenever a slave shall enter Hawaiian territory he shall be free; no person who imports a slave, or slaves, into the King’s dominions shall ever enjoy any civil or political rights in this realm; but involuntary servitude for the punishment of crime is allowable according to law."
This is the U.S. version of the anti-slavery law which was passed after U.S. President Abraham Lincoln died or 13 years AFTER Kamehameha III - Kauikeaouli passed the Hawaiian anti-slavery law:
Passed by Congress on January 31, 1865, and ratified on December 6, 1865, the 13th amendment abolished slavery in the United States and provides that "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.".
The following are other interesting articles in the 1852 Constitution:
39. Art. 39. The King, by and with the approval of his Cabinet and Privy Council, in case of invasion or rebellion, can place the whole kingdom, or any part of it under martial law; and he can even alienate it, if indispensable to free it from the insult and oppression of any foreign power.
41. Art. 41. The King’s private lands and other property are inviolable.
48. Art. 48. Whenever during the vacancy of the throne, or the minority of any heir to it, the office of Kuhina Nui shall become vacant by death, resignation, or otherwise, then the Privy Council, or the major part of them, shall, during such vacancy, have full power and authority to do, and execute all and every such acts, matters, and things, as the King or Kuhina Nui might or could, by virtue of this Constitution, do or execute. And in such case, the Privy Council, immediately after the occurring12 of such vacancy, shall cause a meeting of both Houses of the Legislature, who shall elect by joint ballot a person to fill the office of Kuhina Nui.
